Terms of Service
The agreement between you and NoteWhisper, written to be read. The short version: your memories are yours, you decide what NoteWhisper keeps and does, and you can leave with everything at any time.

1. Who we are and this agreement
These Terms of Service ("Terms") are an agreement between you and Fahd Digital Ventures LLC, a company registered in the United Arab Emirates, which operates NoteWhisper ("NoteWhisper", "we", "us" or "our"). They apply to the NoteWhisper apps, website and related services (together, the "Service").
By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our Acceptable Use Policy. If you do not agree, please do not use the Service.
2. Eligibility and your account
You must be at least 18 years old, or the age of majority where you live if that is higher, to use NoteWhisper.
You are responsible for keeping your sign-in details secure and for activity under your account. If you think your account has been compromised, tell us straight away at security@notewhisper.com.
3. What NoteWhisper does
NoteWhisper helps you capture thoughts you choose to keep, turn them into a personal memory, answer questions about them, set reminders, hold live voice conversations and, when you approve, take actions in accounts you connect. We improve the Service over time, so features may be added, changed or retired. If we remove something important to paid plans, we will tell you in advance.
4. Your content
You own what you capture and store in NoteWhisper, including recordings, notes, imported items and the memories built from them ("Your Content").
You give us a limited, worldwide, non-exclusive licence to host, store, process, transmit and display Your Content only as needed to provide, maintain and secure the Service for you, and as described in our Privacy Policy. This licence ends when Your Content is deleted, apart from backup copies that expire on a fixed schedule and anything we must keep by law.
You are responsible for Your Content and for having the right to capture and keep it.
5. Capturing other people
NoteWhisper is designed for intentional capture of your own thoughts. It is not a tool for recording other people or conversations without their knowledge. If anything you capture includes other people's words or personal information, you are responsible for following the laws that apply to you, including laws about consent to recording and about privacy.
6. Automated answers
NoteWhisper uses automated systems, including artificial intelligence, to understand your captures and to answer questions. Answers can be incomplete or wrong. NoteWhisper shows where its answers come from so you can check them, and you should verify anything important before relying on it.
NoteWhisper does not give medical, legal, financial or other professional advice and does not diagnose any condition. Information about places, routes, opening hours and weather comes from third parties and may be out of date.
7. Connected accounts and actions
When you connect a third-party account, such as Google or Microsoft, you authorise NoteWhisper to access the calendars, lists, contacts and mail folders you select. NoteWhisper only sends a message, creates an event or changes a task after you confirm that exact action, and you are responsible for the actions you confirm. Your use of third-party services is also governed by their own terms.
9. Plans, payment and cancellation
NoteWhisper offers a free plan and paid monthly plans. Paid plans are billed in advance each month until you cancel. Current prices are on our pricing page and are shown before you buy. If a price changes, we will tell you before the change applies to your next billing period.
You can cancel at any time from your account center. Cancellation takes effect at the end of the current billing period, and you keep your paid features until then. Unused Talk time does not carry over to the next period. Refunds are handled in line with applicable law. Purchases made through an app store are also subject to that store's terms.
Ending a paid plan never deletes your memories.
10. Export and deletion
You can export your data or delete your account at any time from your account center. When you delete your account, we delete your personal data as described in our Privacy Policy. Some data may remain in backups for a limited time before it expires, and we may keep limited records where the law requires it, such as billing records.
11. Suspension and termination
We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or to protect other people or the Service. Where it is reasonable, we will tell you first and give you the chance to export your data. You can stop using NoteWhisper at any time.
12. Availability and reminders
We work hard to keep NoteWhisper available and reliable, but we cannot promise it will always be uninterrupted or error-free. Reminders and notifications depend on your device, its settings, your connection and third-party delivery services, so they may occasionally arrive late or not at all. Please don't rely on NoteWhisper alone for anything critical to health or safety.
13. Disclaimers and liability
To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied.
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and 100 US dollars. Nothing in these Terms limits any liability that cannot be limited by law, or your rights as a consumer.
To the extent permitted by law, you agree to indemnify us against claims arising from Your Content or from your breach of these Terms.
14. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will tell you in the app or by email before it takes effect. If you keep using the Service after that date, the updated Terms apply. If you don't agree, you can stop using the Service and export your data.
15. Governing law
These Terms are governed by the laws of the United Arab Emirates. Any dispute will be subject to the jurisdiction of the competent courts of the United Arab Emirates, unless the law where you live gives you the right to bring proceedings in your local courts.
